The Independent Electoral and Boundaries Commission (IEBC) Chairman Wafula Chebukati and Chief Executive Officer (CEO) Ezra Chiloba were cleared and can now run the 26 October repeat election, the high court ruled.
The court dismissed a three voter application who wanted the duo to be barred from conducting the repeat election over claims that they have bungled the 8 august elections.
The high court said the application was premature since the three filled it before the detailed judgment on Raila Odinga’s presidential election petition.
“Clearly, the Supreme Court did not indict the first to eight respondents as alleged nor did it find either of them criminally culpable,” Justice John Mativo said in his rulling.
The three who were seeking the removal of the top IEBC officials said Wafula Chebukati and Ezra Chiloba lost confidence of the public and therefore cannot conduct the repeat election.
